evergreencabin.co.uk is the "website" of Evergreen Cabin which is owned by Green Bus Glamping Limited (herein after called “Evergreen Cabin” or the “company” or “us”). The company reserves the right to change this website, including prices, and terms and conditions, without notice. When you book through Evergreen Cabin website your contract is with Green Bus Glamping Limited.
We also reserve the right to refuse entry to the site, cancel bookings, or instruct people to leave the site, for any reason (for example due to inappropriate behaviour, dangerous weather or site conditions).
By using the Evergreen Cabin Website, making a booking or purchasing any products you acknowledge that you have read and you agree to be bound by and comply with these Terms and Conditions.
Limitation of our liability
Whilst we have taken all reasonable steps to ensure the accuracy and completeness of the information on this Website it is provided on an “as is” basis and we give no warranty and make no representation regarding the accuracy or completeness of the content of this Website. Furthermore, no warranty is given that the Website shall be available on an uninterrupted basis, and no liability can be accepted in respect of losses or damages arising out of such unavailability.
Access to and use of this Website is at your own risk. We do not warrant that the use of this Website or any material downloaded from it will not cause damage to any property, including but not limited to loss of data or computer virus infection. We accept no liability for viruses. We recommend that you take all appropriate safeguards before downloading information or images from the Website.
We shall not be liable to you for any loss of profit; loss of anticipated revenue (whether direct or indirect loss); or any consequential or indirect loss.
Notwithstanding anything in these Terms and Conditions we do not exclude liability for:
a. personal injury and death caused by our negligence;
b. fraud; or
c. any liability under the Consumer Protection Act 1987.
Except for any warranties expressly set out in these Terms and Conditions any warranties, conditions or representations whether implied by statute or otherwise shall be excluded to the fullest extent permitted by law.
Intellectual Property
All Website, design, text and graphics belong to us. All copyright, trademarks and other intellectual property belongs to us.
You are not permitted to use the Website in any way that may infringe the intellectual property rights contained in the Website. This means that you may not adapt, reproduce, publish, upload, extract, alter, store, post, redistribute, reutilise, retransmit or broadcast, all or any of the contents of the Website including but not limited to any trademarks or copyrighted material without our express permission. However, you are permitted to download and print out pages from the Website for the sole purpose of viewing for your own personal information.
Booking
20% of the cost of the holiday will be taken as a deposit at the time of booking.
Full payment will be required 70 days before your stay.
If the booking is less than 70 days from the date of your stay the full price of the stay is required. Confirmation of the booking will be sent after the deposit, or full payment, has been received.
If the balance is not paid by the due date the Big Green Bus reserves the right to re-sell the accommodation and retain the deposit.
Cancellations
If a booking is cancelled less than 70 days before arrival then a charge equal to the full booking amount will be made.
In the event of a no show or booking reduction (after arrival date) the full cost of the booking is charged.
Any cancellation must be confirmed in writing / email, by the person who made the booking.
We strongly advise visitors to take out full holiday insurance to cover cancellations, public liability, personal belongings, loss etc.
In the event that we need to cancel your holiday we shall inform you as soon as possible and refund all money paid to us, by you, within 14 days.
If we close Evergreen Cabin (for instance due to very cold weather and frozen water pipes and drainage) which will mean a lost day or days to your booking and you have yet to arrive you will be refunded.
Arrival and Departure Times
Guests must check in between 3pm and 7pm and check out by 10am. Please advise us of your estimated arrival time.
Your visit to Evergreen Cabin and wider woodland
Guests and visitors agree to be considerate tenants and to take good care of Evergreen Cabin and facilities during their stay. Guests and visitors agree not to act in any way which would cause disturbance to the neighbours. Should any facilities or equipment be damaged wilfully, as a result of inappropriate usage or behaviour, or a as a direct result of failing to respond to instructions from Company staff you will be held responsible for the cost of repair or replacement of that item. The company cannot accept responsibility from any loss, damage, or expense arising from industrial action, terrorist activity, adverse weather conditions or any other event outside the control of the company.
Evergreen Cabin is set in a natural woodland environment. In working to preserve and enhance the woodland and it’s bio diversity, and create a sense of freedom which is part of the charm and why many people come, there are natural hazards, such as streams, tree roots, poisonous plants, and extremely limited lighting after dark, and depending upon weather conditions, cold, wet and slippery surfaces.
The woodland is home to a wide range of animals and insects. Thus depending upon the time of year certain creatures such as wasps, field mice and spiders may enter the bus.
By booking and coming to Evergreen Cabin you agree to be responsible for your children and any dependants of children you are in charge of, and your own welfare and to take all reasonable precautions against personal injury, injury to others and damage to the woodland, facilities and accommodation, such as regarding litter, fire, noise after 11.30pm. Amplified music (instruments or radios etc) is not permitted.
Anything you bring to the campsite or wider woodland and any damage or loss to your possessions is at your own risk. You use the facilities and amenities at the camp and wider woodland at your own risk, e.g. the campfire and hot tub. The Company accepts no responsibility from any loss or injury arising from being in on the site or wider woodland (known as Vert Woods). By booking, and acknowledging these Terms and Conditions, you are aware of the risks, hazards, and dangers of personal injury in entering the site and woodland. (For example, the woodland contains deadly poisonous mushrooms, toadstools, and fungi.)
Glamping in Britain can mean dramatic variance in weather in a short period of time (“4 seasons in one day”). Whilst we supply certain facilities and equipment. It is still glamping and you are responsible for your own well being and comfort regarding appropriate clothing and footwear etc. In extreme weather conditions, such as exceptional cold and snow, where existing and / or forecast we do our best to warn guests and give guests the option to move dates (subject to availability) without being subject to the cancellation policy administration handling charge, or loss of any monies. Also, because of the nature of Evergreen Cabin and its location there may be instances where there is an interruption in electrical and water supply.
Non Paying Guests
No Non Paying guests are permitted on the site at anytime. We are happy to suggest great places nearby for you to meet friends and family.

In the first instance of a complaint, please call Adam so we can work to resolve your problem, as quickly as possible.

Please note, complaints received after your stay cannot be reliably investigated and therefore most difficult to resolve. Also bringing any issues to our attention allows us to seek to remedy it as quickly as possible and lessen any adverse impact on your stay.

Entire Agreement
These Terms and Conditions represent the entire understanding relating to the use of the Website and supersede all other statements, representations or warranties (whether written, made by email or oral) made by us. Nothing in these Terms and Conditions shall affect the liability of either party in respect of any misrepresentation, warranty or condition that it makes fraudulently. Any rights not expressly granted in these Terms and Conditions are reserved by us.
Severance
If any provision of these Terms and Conditions are found to be invalid or unenforceable by a court, it will be severed from the rest of these Terms and Conditions which shall remain unaffected.
Third Party Rights
A person who is not a party to this contract is not entitled to enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.
Force Majeure
We shall not be liable to you for any delay in, or failure of, performance of our obligations under these Terms and Conditions arising from any cause beyond our reasonable control including any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion, failure in information technology or telecommunications services, failure of a third party (including failure to supply data) and industrial action.
Law and Jurisdiction
These Terms and Conditions will be governed by and construed in accordance with the laws of England and Wales. Disputes arising in relation to this Website shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Certain provisions contained in these Terms and Conditions may be disallowed by the laws of the country from which you are accessing the Website. If any provision is unenforceable or invalid then the provisions of paragraph 11 shall apply.
